        <![CDATA[<p>Every year, about 4.7 million dog bites are estimated to occur in California and throughout the country, with more than half of the victims of these bites under the age of 14. To call attention to (and reduce) this large number, the week of May 21-26 has been designated as Dog Bite Prevention Week in the U.S.</p>
<p>It is not terribly surprising that children between the ages of 5 and 9 are the most common victims of <a href="http://www.bendergritz.com/PracticeAreas/Dog-Bites.asp" target="_blank">dog bites</a>. Children are curious by nature, especially about animals, and they are taught that dogs are their friends. However, most children do not know how to properly treat animals, yelling at them or pulling on their fur or ears, which can easily spook or anger a dog and result in a dangerous situation.</p>]]>
        <![CDATA[<p>Certainly, a dog owner is the person who is responsible should their pet cause any harm to a child or anyone else, regardless of the severity of the injury. However, there are a few things that parents and dog owners alike can do to prevent these injuries from taking place at all.</p>
<p>First, parents who are adding a dog to their family should pick one that will be a good match with their children. A veterinarian can offer suggestions as to safe, even-tempered breeds that will not pose a significant risk. Second, the pet should be exposed to a variety of people, animals and situations so it becomes well-socialized.</p>
<p>Third, teach your children how to behave around the dog. Kids should not bother a dog if it is eating, sleeping or caring for puppies, and they should not run past a dog. Children of all ages should be supervised when around dogs, but babies and very young children should never be left alone with a dog.</p>
<p>Finally, all dogs should be vaccinated against rabies, so if a bite occurs the victim will not need to undergo the series of rabies vaccinations.</p>

<p>But it seems that teen crash deaths increased during the first half of 2011 according to preliminary data from that period. Now, officials are wondering whether the effectiveness of graduated licensing has run its course, and how to continue to increase safe driving behaviors among teenage drivers.</p>]]>
        <![CDATA[<p>With the release of a new study, it is likely that officials will focus on the number of other teens in a vehicle when a teenage driver is behind the wheel. In the study, which was completed by the AAA Foundation for Traffic Safety, researchers found that teens have a significantly heightened risk of dying in a car accident when multiple peers are in the car.</p>
<p>Specifically, researchers found that the risk of death to a 16- or 17-year-old driver increases by about 44 percent when that driver is transporting one passenger under the age of 21. The risk doubles when the driver is carrying two passengers under 21, and quadruples when three passengers under 21 are in the vehicle.</p>
<p>To contrast, a teen driver who has a passenger over the age of 35 in the car has a 62 percent lower risk of being killed in an accident.</p>

        <![CDATA[<p>Last week, Junior Seau, a long-time member of the San Diego Chargers professional football team, committed suicide in his Oceanside home. Now, many are wondering whether Seau's death was the direct result of the concussions and other brain injuries that he likely suffered during his long football career.</p>
<p>Unfortunately, Seau's suicide is not the first of its kind. Last year, former NFL linebacker Dave Duerson died of a self-inflicted gunshot wound to the chest. In a suicide note, Duerson asked that his brain be donated to the Boston University School of Medicine in order that the connection between <a href="http://www.bendergritz.com/PracticeAreas/Head-Brain-Injuries.asp" target="_blank">brain injury</a> and depression be further studied. Researchers later determined that Duerson had suffered from a neurodegenerative disease which was caused by his many concussions, and which triggered the depression that caused him to take his life.</p>]]>
        <![CDATA[<p>While Seau left no such note, the similarities between the two deaths has caused many to believe that a similar disorder may have caused Seau's suicide. Currently, his family is deciding whether to donate his brain to the same university at which Duerson's was studied.</p>
<p>Seau, who was 43 at the time of his death, was an All-American at USC before joining the San Diego Chargers in the position of linebacker, where he played for 13 seasons. He then spent three seasons with the Miami Dolphins and four with the New England Patriots before retiring in 2009.</p>
<p>Although Seau was not publicly known for suffering brain injuries, his ex-wife told ESPN that he had recovered from multiple concussions during his career. "Of course he had. He always bounced back and kept on playing," she said. "I don't know what football player hasn't."</p>

        <![CDATA[<p>Last month, Interstate 805 was the setting for a dramatic scene in which rescuers worked to free the occupants of an SUV as the vehicle dangled perilously over the edge of the freeway. While officials were able to get all five passengers out of the vehicle, the <a href="http://www.bendergritz.com/PracticeAreas/Personal-Injury.asp" target="_blank">auto accident</a> unfortunately caused one of the SUV's occupants to suffer a head trauma which ultimately led to her death.</p>
<p>According to police reports, the crash took place at about 6:30 a.m. as the San Diego family, including parents, two children and a grandmother, drove to spend the day in Disneyland. On I-805 near Sorrento Valley, another vehicle on the road was cut off by a car, forcing the driver to swerve into the SUV carrying the family.</p>]]>
        <![CDATA[<p>The force of the impact caused the SUV to spin out of control and roll over several times, eventually coming to rest on its wheels on a concrete wall 30 feet above a construction site.</p>
<p>According to a Caltrans spokesperson, highway workers at the scene of the accident worked quickly and delicately to extract the family from the vehicle. They positioned a forklift beneath the SUV in order to keep it from plunging off the freeway and causing greater injury. Firefighters, police officers and tow-truck drivers assisted with the rescue when they arrived on the scene.</p>
<p>The father suffered broken ribs as well as several cuts and bruises. The mother and two children suffered minor injuries. Unfortunately, the grandmother suffered a major head trauma in the crash and later died.</p>

        <![CDATA[<p>At least three people have been killed and a fourth is missing following the third major boat racing accident in California waters in recent weeks. The recent surge in <a href="http://www.bendergritz.com/PracticeAreas/Boating-Accidents.asp" target="_blank">boating accidents</a> has prompted the U.S. Coast Guard to suspend all sailboat racing in the Pacific Ocean near southern California for the near future as officials work to determine the cause of the crashes.</p>
<p>The boat that was involved in the latest fatal accident was a 37-foot yacht named Aegean. The sailors were participating in a race from Newport Beach, about 90 miles north of San Diego, to Ensenada, Mexico. The yacht departed from Newport Beach on Friday and was scheduled to arrive in Mexico on Sunday.</p>]]>
        <![CDATA[<p>Early Saturday morning, however, the Aegean disappeared off the race organizers' tracking system while it was sailing several miles off of the coast near the border of California and Mexico.</p>
<p>Coast Guard officials concluded that the fatal boating accident was the result of the Aegean's collision with a much larger vessel. The force of that impact caused the deaths of three of Aegean crew members, and an additional sailor remains missing. The Coast Guard has not yet identified the people killed in the crash.</p>
<p>The boat accident was the third of its kind in less than a month. Recently, we wrote about a fatal accident that took the lives of four experienced sailors off the coast of San Francisco. You can read about that crash in our earlier personal injury blog post. In addition, two participants in a round-the-world race were injured when a wave crashed into their ship in late March.</p>

        <![CDATA[<p>For the first time since the 1950s, the largest manufacturers of football helmets in the United States are working to redesign their products. The goal is not to find a faster helmet, or one that is better-looking, but to create a helmet that can do more to prevent <a href="http://www.bendergritz.com/PracticeAreas/Head-Brain-Injuries.asp" target="_blank">head and brain injuries</a> in football players of all ages.</p>
<p>The research and redesign is due to the recent increase in attention on the life-altering effects of brain injuries that occur during the course of a normal football game. As we wrote in an earlier San Diego <a href="http://www.sandiegopersonalinjury-law.com/2012/02/series-of-hits-may-cause-brain-greater-injury-than-one-incident.shtml" target="_blank">personal injury blog</a> post, a study recently found that it is not only severe hits that cause head injury on the football field, but usually a series of smaller, less notable hits which are unfortunately standard in just about all football games.</p>]]>
        <![CDATA[<p>This means that all players need to be better protected from such hits. And because the game is unlikely to change significantly, the helmet is where parents, coaches and officials are turning to find a solution and protect their players.</p>
<p>Last year, a high school in Georgia piloted a new helmet design developed by two sports equipment companies. The product is actually a helmet cover called the Guardian, with 37 gel-filled pouches that cushion against helmet-to-helmet hits. Although the covers have just been worn during practice due to league rules, the coach says that they appear to be making a difference.</p>
<p>"The year before we used the Guardian, we had 10 to 12 kids that had to either miss a practice or two or even a game because of head-injury symptoms. And this year, we had zero," he said. "So from that aspect, I'm sold on it."</p>

        <![CDATA[<p>According to a new set of studies, a motorcyclist is at the highest risk of being involved in a motorcycle accident during his or her first year on the road. In fact, that risk is the highest during the motorcyclist's first 30 days of riding, which are an average of four times more dangerous than his or her entire second year on the bike.</p>
<p>This data is not entirely surprising, says one of the study researchers. He says that most <a href="http://www.bendergritz.com/PracticeAreas/Motorcycle-Accidents.asp" target="_blank">motorcycle accidents</a> involving new riders are the product of the motorcyclist's lack of experience on a complicated machine. For example, motorcyclists must simultaneously perform at least six actions to simply pull out on a hill: brake, balance on one foot, feather the throttle, shift the gear, release the clutch, and watch for oncoming traffic. This can be a lot to handle for even the most experienced riders.</p>]]>
        <![CDATA[<p>Interestingly, the study also states that motorcycle education courses may not lower the rider's chances of being involved in a crash during those first days and months on the bike. In fact, such courses may actually increase the accident risk. Researchers reportedly found that, in the U.S. states that require training programs for new riders under the age of 21, accident insurance claims were about 10 percent higher than states without such requirements.</p>
<p>Researchers believe that the higher crash rate is because the training courses often fast-track a rider to the road, reducing the amount of time and other requirements for the rider to become fully licensed.</p>

In the most severe cases or when an accident occurs in a remote location, you may be transported by helicopter. It might not occur to you until you or a loved one is involved in a serious <a href="http://www.bendergritz.com/PracticeAreas/Personal-Injury.asp" target="_blank">car accident</a> or suffers a serious injury, but a new study shows that how you travel to the hospital could make a difference. Interestingly, these methods of transport can have an impact on the level of care you receive and the likelihood of survival.</p>
<p>Research shows that those who suffer serious injuries may have a better chance of surviving if they are taken by helicopter rather than an ambulance. It is believed that the both the speed of transport and the crew aboard the helicopter contribute to the increased level of care and safety for victims. It is possible that ground crews do not have the same tools and training as those in the helicopters, according to one of the researchers.</p>]]>
        <![CDATA[<p>While the difference in numbers was not staggering, they do suggest that helicopter transport is better for patients, even when the duration of travel was same. If you or someone you love is involved in an accident, an ambulance transport may not be the best option.</p>
<p>A helicopter is normally used when a patient is more than 30 minutes away by ground. While they can be more costly, transport by helicopter can increase the rate of survival for victims of serious injury. While the research needs further analysis and development, this study suggests that those who travel by helicopter tend to do better than those who are transported by ambulance.</p>

        <![CDATA[<p>When we hear of a fatal accident that took place during an inherently dangerous activity, many of us are quick to judgment, assuming that inexperience and risky behavior most likely caused the crash. In many cases, though, the opposite is true. That is the case with a recent <a href="http://www.bendergritz.com/PracticeAreas/Boating-Accidents.asp" target="_blank">California boating accident</a>, in which the people involved were sailing experts who simply happened upon an unlucky situation that ultimately cost them their lives.</p>
<p>The fatal crash took place during the annual Full Crew Farallones Race on the Marin County waterfront. Held every year since 1907, the race is known among yachting circles as one of the toughest races of its kind. This was proved true when the Low Speed Chase, carrying eight veteran crew members, was hit with a series of towering waves.</p>]]>
        <![CDATA[<p>According to media reports, the first deadly wave hit the sailboat as it rounded the Falloran Islands, washing five crew members overboard. When the remaining people aboard attempted to save the sailors, they were hit with another wave that pushed the boat onto the rocks, destroying it.</p>
<p>When the U.S. Coast Guard arrived on the scene, they found one deceased crew member in the water, and were unable to locate the other four people who had been washed overboard. The following evening the Coast Guard called off its search for those four, stating that the "window of survivability" had closed.</p>
<p>All eight crew members on the boat at the time of the accident were boating veterans, many of whom had sailed since they were young children. They were reportedly all wearing life jackets at the time of the crash.</p>

<p>In the study, researchers examined about 90 brain injury patients, dividing them into three groups based on the severity of their injury. The first group had people with mild injuries, the second contained people with injuries that the doctors classified as 'complicated mild', and the third had people with moderate to severe brain injuries. The brain injury patients were also compared to a control group of about 40 people without such an injury.</p>]]>
        <![CDATA[<p>The researchers evaluated the study participants on five standards of decision-making: expressing choice, reasonable choice, appreciation, reasoning and understanding. They found that patients in the 'mild' group showed little impairment of their decision-making ability one month after their head injury, while patients in the other two groups showed significant deficits in their ability to make decisions after the same amount of time.</p>
<p>Doctors, nurses and other professionals who work with patients in the aftermath of a traumatic brain injury should take note of the study results, according to researcher Kristen Triebel, Psy.D. "Until we know more about the time required for return to normal decision-making capacities," she said, "physicians need to carefully assess decisional capacity in their TBI patients, particularly those with complicated, moderate or severe TBI."</p>

        <![CDATA[<p>It goes without saying that Tax Day can be stressful. But according to a new study, that added stress can manifest itself in an unusual way: by increasing the occurrence of fatal motor vehicle accidents.</p>
<p>The study examined <a href="http://www.bendergritz.com/PracticeAreas/Personal-Injury.asp" target="_blank">auto accident</a> deaths on and around Tax Day over a 30-year period, comparing the number of fatalities that occurred one week before the tax filing deadline, on the Tax Day itself, and one week after the deadline. Researchers found that there were an average of 226 traffic deaths on Tax Day, as compared to 213 on the other days studied.</p>]]>
        <![CDATA[<p>This amounted to a six percent increase in the traffic fatality rate on Tax Day. While an added 13 deaths nationwide does not seem like much, it means about a $40 million extra annual loss to society, considering the loss of life, injury and property damage costs.</p>
<p>Researchers are not completely certain of the reasons for the increase, but stress likely has something to do with it. People who are stressed are easily distracted, and tend to make more errors behind the wheel.</p>
<p>Another possible reason is extra motorists on the road who are driving unfamiliar routes - to the post office to mail their tax return, for example. However, the study did not indicate that the Tax Day fatality rate has declined in conjunction with the increasing popularity of electronic tax filing, so this may not be a significant factor.</p>
<p>When asked for a statement, a spokesperson for the IRS declined to comment on the study.</p>

<p>With laws banning both texting and talking on hand-held cell phones behind the wheel, California is leading the charge against distracted driving. Since those laws were implemented just two years ago, the number of car accident deaths in the state dropped by more than 20 percent.</p>]]>
        <![CDATA[<p>This month, the California Highway Patrol (CHP) will work with more than 200 local police agencies to enforce the statewide ban, cracking down on drivers who are texting and talking on their cell phones or other electronic devices.</p>
<p>The California Office of Traffic Safety has also created a public campaign to educate and make drivers aware of distracted driving. The campaign is called "Don't be a zombie behind the wheel," based on the fact that drivers who are talking or texting are not fully present and engaged, with noticeable effects on their driving skills.</p>
<p>In recent months, we have focused many of our personal injury blog posts on distracted driving, and for good reason. According to one police officer, distracted driving crashes are usually the most harmful. "The types of accidents caused by distracted driving can be the worse we see," he said. "The accidents caused by you not paying attention so you don't have a chance to react and suddenly you're in an oncoming lane of traffic or you've hit a tree - these crashes are usually very severe."</p>

        <![CDATA[<p>Any of our San Diego readers who have been paying attention to news stories and government releases in the past year will likely be surprised by the fact that teenage drivers are among the most dangerous motorists in the country. For many years, the primary cause of the increased <a href="http://www.bendergritz.com/PracticeAreas/Personal-Injury.asp" target="_blank">auto accident</a> risk among teen drivers was a lack of driving skill and experience.</p>
<p>In recent years, however, distraction has become the focus of the government's efforts to increase teen driver safety. A recent study has reached an interesting conclusion which may help further narrow that focus: teenage girls are 10 percent more likely to engage in distracted behavior behind the wheel than teenage boys.</p>]]>
        <![CDATA[<p>In the study, which was completed by the AAA Foundation, researchers examined nearly 8,000 in-car camera recordings of unsupervised teenage drivers. The clips revealed that cell phones and other electronic devices were the most common distractions for teens, and that girls were about twice more likely to talk on cell phones behind the wheel than boys.</p>
<p>Other common sources of distraction were eating and drinking, adjusting music and other vehicle controls, and grooming. Older teenagers were more likely to engage in careless behavior behind the wheel than newly-licensed drivers, and more passengers in the car increased the risk of a car crash or similar incident.</p>
<p>According to federal government statistics, motor vehicle accidents are the number one cause of death for teenagers in the U.S. Hopefully, this study will be an impetus for California and other states to increase the strength of their teen driving laws.</p>

        <![CDATA[<p>The widow of a fallen police officer has filed a wrongful death against two California cities and another police official, claiming that they are responsible for the death of her husband. The cities have already denied claims filed by the widow under a legal rule which she claims is inapplicable and outdated.</p>
<p>The fatal <a href="http://www.bendergritz.com/PracticeAreas/Motorcycle-Accidents.asp" target="_blank">motorcycle accident</a> took place last May, during the funeral procession of a California police officer who had died of cancer. The widow's husband, a 44-year-old motorcycle officer, was working as a funeral escort when suddenly, a police sergeant who had been assisting a vehicle that had accidentally cut into the procession, cut back into the line.</p>]]>
        <![CDATA[<p>The sergeant struck the husband, causing his motorcycle to be thrown into oncoming traffic. The husband landed on a vehicle and suffered massive blunt force traumatic injuries, from which he later died.</p>
<p>Now, the widow has filed a <a href="http://www.bendergritz.com/PracticeAreas/Wrongful-Death.asp" target="_blank">wrongful death</a> lawsuit on behalf of herself and her two sons against the city that was operating the procession, the sergeant who struck her husband, and the city that employed the sergeant. In the suit, the widow claims that the sergeant was unfit to operate a police motorcycle and that he was driving recklessly at the time of the crash. In addition, the suit claims, the city did not provide sufficient motorcycle training for the sergeant.</p>
<p>The cities have previously denied $25 million claims filed by the widow, citing the 'fireman's rule' which generally precludes any liability for emergency responders. The widow is fighting against that claim, arguing that this was not an emergency situation by any means, and that the cities are therefore liable for her husband's death.</p>

        <![CDATA[<p>Every year, 1.7 million people suffer a brain injury. Car and boat accidents are the leading cause, a reminder that a person's life can change dramatically in an instant. This is what the 19-year-old sister of California ultimate fighter Urijah Faber discovered recently when she was involved in a car crash that left her in a coma. When she awakened eight days later, surgery had already been performed to treat her <a href="http://www.bendergritz.com/PracticeAreas/Head-Brain-Injuries.asp" target="_blank">brain injuries</a> and she was informed that she had suffered a collapsed lung, a fractured tailbone, and was paralyzed on the right side of her body.</p>
<p>The teen had been driving west on Highway 80 with a friend after several hours of shopping for Black Friday bargains at the Roseville Galleria. She swerved to avoid a collision that had taken place on the Auburn/Riverside exit ahead. Her quick reaction allowed her to avoid the collision, but she struck another vehicle. The teen was the most seriously injured.</p>]]>
        <![CDATA[<p>Since then her life has been filled with medical treatments including checkups with her doctor, sessions in the oxygen chamber at the Hyperbaric Oxygen Clinic in Sacramento, and working to improve her short-term memory.</p>
<p>In addition to working on her own rehabilitation, the California teen is working to raise awareness of the more than 5 million people in the United States who are living with disabilities as a result of traumatic brain injuries. She recently joined around 800 others in the Sacramento Walk for Thought, a three mile walk sponsored by the Brain Injury Association of California.</p>
<p>Unfortunately, the teen was unable to avoid the car crash that has changed her life dramatically, but her tenacity and dedication to getting stronger every day are an inspiration to others who have suffered brain injuries.</p>
